1. Closure of Contract

For orders placed on our online shop, a binding acceptance for the conclusion of a contract is made with Iris4u Greenhouse, Faassweg 6, 20249 Hamburg, Germany

By placing an order with Iris4u Greenhouse, the Customer submits a binding agreement for the conclusion of a contract with Iris4u Greenhouse.  Iris4u Greenhouse will send confirmation of order submission via email to the email address provided at the time of registration, within 24 hours of receipt.  In the case that a product is not available, there is no obligation to fulfill the contract.  The order confirmation that the Customer receives, acts as Iris4u Greenhouse’s acceptance for the conclusion of contract.

 

2. Archiving of Contract

When ordering electronically online, the Customer’s order details will be stored in their personal customer account if a customer account has been created.  Login details which are specified by the Customer at the time of registration, allow the Customer to access his/her customer account at any time as well as have the option of printing past and current orders.  This function is not available to Customers who decline to create a Customer Profile and submits an order as a <Guest>.  Iris4u Greenhouse will send confirmation of order submission via email to the email address provided at the time of order submission.

 

3. Prices and Shipping/Handling Costs

  • All online prices are in Euro and include the legal VAT.
  • There is no minimum order value.
  • The current legal VAT is shown separately in the order confirmation.
  • Packaging and handling costs are included in the shipping fee.
  • Orders are sent within Germany and the EU with DHL Parcel Service

 Destination Address: Germany Only

Orders valued €65,00 or more qualifies for free shipping.
Orders valued under €65: €6,50 flat-fee.

 

Destination Address: European Union

Orders valued €100,00 or more qualifies for free shipping.
Orders valued under €100: €20,00 flat-fee.

*Important* Iris4u Greenhouse will only deliver to destinations within Germany and the European Union.  If the delivery address is outside of the EU, (e.g. Norway, Russia, Switzerland, Turkey, Ukraine), and the Customer would still like to place an order with Iris4u Greenhouse, we would encourage you to use a family, friend or postal box with a mailing address inside the EU.

 

4. Terms of Payment and Delivery

Terms of Payment

Iris4u Greenhouse will only ship against prepayment.  Payments are possible either by bank transfer or Paypal.  Please be respectful and prompt with your payment. No order is final or guaranteed until full payment has been received.

For bank transfers, payment must be received within 10 days of order confirmation

Changing an Order

The number of iris available during our season is limited.  Should there be insufficient quantities due to growing conditions, Iris4u Greenhouse can withdraw from the contract.  In this case, Iris4u Greenhouse will inform the Customer immediately and, if necessary, propose a substitution of a comparable item.  If no comparable item is available or if the Customer does not wish to receive a comparable item, Iris4u Greenhouse will reimburse the Customer for any consideration already paid. Other claims for compensation against the seller may be addressed separately.

After an order has been submitted, and the Customer would like to make a change, Iris4u Greenhouse is happy to accommodate, provided that the Customer’s order has not yet been processed.

Any request of change is subject to availability and must be made in writing per e-mail to info@iris4u.de.  Any additional costs associated with these changes, must be settled by the Customer immediately after receiving a change confirmation, either by bank transfer or Paypal.  Iris4u Greenhouse will reimburse the Customer for any consideration already paid when the changes made are less in value than the original order.

 

Cancellation of an Order

If the need to cancel an order should happen, Iris4u Greenhouse kindly requests the Customer to contact us as soon as possible either by e-mail or telephone.  Please note the following cancellation terms and fees associated with processing the Customer’s cancellation request.

  • Within 10 days of receipt of online order: No charge
  • After the 11th day of receipt of online order:  3€ processing fee
  • 4 weeks prior to scheduled delivery date: 15% of order value processing fee .

 

Terms of Delivery and Delays

Your package will be sent when it is the optimal time to plant, therefore your ordered Iris will not be dug or prepared for transport before the end of July / beginning of August.  The plants will be sent as bare root with the leafy green cut back.  We process all orders in the order they were received.  An email will be sent approximately one week prior to order processing to announce exact delivery week.

If you know you will be away or need to request an alternative delivery date of your parcel, please contact us via email, info@iris4u.de or by phone +49 (040) 235 478 96.  It is very important that you include your order number in your e-mail and specify an alternative delivery date.  We will do our best to take this change into account.  Please note, a later delivery date will mean a shorter growth period for your new plants before winter comes!

Unless explicitly agreed by Iris4u Greenhouse, an alternative delivery date is not deemed binding.

 

5. Damage during Transport

In the event plants are damaged while in transport, please make a claim directly with the parcel service DHL, and contact us immediately at +49 (40) 235 47 896.

Failure to file a complaint or to contact us has no influence on your legal guarantee claim.  It does however help us in submitting our own claim against the carrier or transport insurance.

 

6. Guarantee

All plants are freshly dug, labeled true to name and healthy when shipped.  We cannot accept responsibility for plants lost due to climate or garden conditions.

 

7. Liability

Our liability does not include breach of duty due to minor negligence aslong as it does not pertain to any of our basic contractual obligations or cause damage resulting in death, bodily injury or poor health, or to any warranty or claims in terms of the product liability laws.

9. Callback Service

If you have questions, you can call us at any time during the day at +49 (40) 235 47 896 and leave a message on the answering machine.

 

10. Final Provisions

Should a provision of these General Terms of Service be ineffective, the contract remains otherwise valid. In place of the invalid provision, the relevant statutory provisions apply.

German law is exclusively applied to this business.
